Definition and object of the contract

These general conditions apply to purchase and sale contracts concluded online (hereinafter: “Contracts”) by means of distance communication techniques through the store.flamigni.it website. Contracts are concluded between store.flamigni.it of the company FLAMIGNI SRL – VIA M.L. KING 17, 47121 FORLI’ and consumers/buyers/customers (hereinafter: “Customers”) who wish to purchase products marketed by it (hereinafter: “Products”). Contracts entered into with shop.flamigni.it through the website shop.flamigni.it are governed by Italian law and in particular by D. Lgs. 9 April 2003 nr. 70 (rules on electronic commerce).If the Customer is a consumer, or a natural person acting for purposes unrelated to professional activity, the Contract is also governed by the rules laid down by D. Legislative Decree No. 206 of September 6, 2005 (hereinafter: “Consumer Code”).These General Conditions of Sale (hereinafter: “General Conditions”) and in particular the information referred to in art. 52 of the Consumer Code will be displayed prominently on the Site and will be valid and effective until they are modified and/or supplemented by shop.flamigni.it. Any amendments and/or supplements to the General Conditions will be effective immediately and will apply to sales made as of that date. In any case, the updated version of the General Conditions will be available on the Site.

Contractual Scope

Use of the Site is permitted only to individuals who:
a. have read and accepted the policy regarding the processing of personal data (link: “Privacy Policy”);
b. have accepted these General Conditions;
c. are of legal age.

Acceptance of general terms and conditions

Before proceeding to finalize the Contract, the Customer must read the General Terms and Conditions and accept them by clicking on the corresponding box during the ordering process.

Terms and conditions of purchase

For the purchase of one or more Products on the Site, it is necessary to fill out the order form (hereinafter: “Order”) in electronic format prepared on the Site and send it to shop.flamigni.it following the relevant instructions and at the same time accept the General Conditions.It will be necessary afterwards to provide for the payment with the chosen method, shop.flamigni.it undertakes to confirm the receipt of the Order by sending an email to the email address provided by the Customer at the time of the request (hereinafter: “Summary Email”).

In the Summary Email, shop.flamigni.it undertakes to communicate to the Customer a summary of the main commercial conditions, general information on the characteristics of the product, including the availability of Products existing at the time of the Order, the individual price, transportation costs, payment and delivery methods, the right of withdrawal, as well as the total amount to be paid for the order requested by the Customer.

Methods of payment

Payment can be made through the following methods: PayPal/credit card (PayPal account, Visa, Mastercard, Maestro, American Express, Discover, Aura), Satispay.

PayPal / Credit and prepaid cards are the most popular and secure payment methods used on the Internet for online purchases. Users who already have a PayPal account can make the payment through the wizard on the site, for those who do not have such an account will be possible to create one, or proceed with the purchase without registration, simply with their usual credit card. Language

The proposed language for finalizing the contract is Italian.

Product availability

If after sending the Order for the purchase request made by the Customer, the selected Goods are not, for any reason, available, the Seller undertakes to notify the Customer as soon as possible and in any case before proceeding to the email confirmation of the shipment of the goods to the Customer. The same email will indicate the possibility of purchasing other goods of the same or better quality than those requested by the Customer. In any case, in the summary email, the Seller undertakes to inform the Customer of the essential characteristics of the goods offered and any other information.
The Seller undertakes to immediately notify the Customer of the depletion of the goods occurred for unforeseeable causes and not attributable to him, inviting the Customer to place another Order. If the Customer does not accept the new proposal, he may withdraw from the Contract.

In the event of withdrawal from the Contract for the reasons stated above, the Seller shall notify the Customer of the terms and procedures for refund of the price paid.

Mode and cost of transportation

Our deliveries are always express, the delivery time of goods is indicated on the website, the exact amount of delivery costs is clearly stated in the Order procedure.

Orders created on the Flamigni shop have a selection of EU and Extra EU countries as shipping destinations and a predetermined maximum weight limit as products.

Price

The prices of our Products contain the applicable VAT according to current legislation. The prices shown on our website are in euros. Shipping costs are not included in the prices shown on our website. Additional costs that may originate will be borne by the Customer, who will be informed of all amounts and the final price before the contract is finalized. Deliveries made to destinations outside the European Union may incur additional costs and be subject to taxes and duties, especially of a customs and import value-added nature. All costs originated for the non-EU destination will be assumed by the Customer.

Right of withdrawal

You have the right to withdraw from the contract, without giving reasons, within 14 days from the date of delivery. The withdrawal period expires after 14 days from the day 1. To exercise your right of withdrawal, you must inform us from the day of your decision to withdraw from this contract by an explicit statement to the e-mail address shop@flamigni.it In order to comply with the withdrawal period, it is sufficient for you to send the notice regarding the exercise of your right of withdrawal before the withdrawal period expires. Make sure the products are in the same condition as you received them, with all tags attached. Prepare the package in the box you received (or on a box of equal strength and size) by covering or detaching the information from the first shipment.

Effects of withdrawal

When our warehouse has received your return and verified that all conditions have been met, it will send you an e-mail confirming acceptance of the return. You will be refunded all payments you have made to us, including delivery costs (except for additional costs resulting from your possible choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event no later than 14 days from the day on which we were informed of your decision to withdraw from this contract. Said refunds will be made using the same means of payment that you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any costs as a consequence of such a refund.

Intellectual Property Rights

All rights to the site and all materials contained therein as well as to trademarks and/or distinctive signs and/or any and all materials or content on which intellectual, industrial or any other property rights exist are exclusively those of shop.flamigni.it and/or other parties and/or its assigns. No rights are attributed to the customer.

Jurisdiction

The contract is governed by Italian law, any dispute relating to the application, execution, interpretation and breach of the Contract shall be submitted to the jurisdiction of the court of Forlì.

Limitations of liability

shop.flamigni.it cannot be held liable in any way for delays in the delivery of the Goods or non-delivery of the same, if the delay or non-delivery was caused by exceptional or unforeseeable circumstances, such as but not limited to civil unrest, intentional damage, fire, flood, storm or supernatural events, interruption of an ISP or telecommunications provider, relating to the performance of the contract. These Terms and Conditions do not govern the sale of Products and/or the provision of services by parties other than shop.flamigni.it that may be present on the Site through links, banners or other hypertext links. Before carrying out commercial transactions with such subjects, it is necessary for the registered user to check their conditions of sale. shop.flamigni.it is in no way responsible for the provision of services and/or the sale of Products by such subjects.
